By accessing or using Plant Planner ("the Service"), operated at plantplanner.com.au, you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service.

2. Description of Service

Plant Planner is a web application that helps Australian home gardeners plan, track, and optimise their raised vegetable garden beds. The Service provides:

Crop recommendations based on your climate zone, bed dimensions, and family size
Planting schedules and harvest calendars
AI-powered garden optimisation and suggestions
Email reminders for garden tasks
Community features for sharing your garden publicly (opt-in)

3. Accounts

You must provide accurate information when creating an account
You are responsible for maintaining the security of your account
One account per person. Accounts are not transferable
We reserve the right to suspend or terminate accounts that violate these terms

4. Subscriptions & Payments

Free tier: Up to 2 garden beds with basic features, no payment required
Paid plans: Pro ($5/month) and Family ($10/month) with additional features
Payments are processed securely by Stripe
Subscriptions renew automatically. You can cancel at any time
Refunds are handled on a case-by-case basis. Contact support for assistance
We may change pricing with 30 days notice to existing subscribers

5. User Content

You retain ownership of content you upload (garden photos, notes, etc.). By uploading content, you grant us a licence to:

Store and display your content within the Service
Display your garden publicly if you have opted into a public profile
Use anonymised, aggregated data to improve our recommendations

You must not upload content that is illegal, offensive, or infringes on others' rights.

6. Public Profiles & Community

Public profiles are strictly opt-in. Your garden is private by default
When enabled, only your first name, postcode, climate zone, bed photos, and crop list are visible
Your email, full name, and private data are never shared publicly
You can disable your public profile at any time in Settings
We reserve the right to remove public profiles that contain inappropriate content

7. AI-Powered Features

AI suggestions are provided as guidance, not professional agricultural advice
Crop recommendations are based on general climate zone data and may not account for your specific microclimate
Planting dates and yields are estimates. Actual results vary based on soil, weather, and care
We are not liable for crop failures resulting from following AI recommendations

8. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorised access to the Service or other users' accounts
Scrape, crawl, or use automated tools to extract data from the Service
Upload malicious content or attempt to compromise the Service's security
Resell or redistribute the Service without permission

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by Australian law:

We are not liable for any indirect, incidental, or consequential damages
Our total liability is limited to the amount you paid us in the 12 months preceding the claim
We do not guarantee uninterrupted access to the Service

10. Australian Consumer Law

Nothing in these terms excludes or limits any rights you have under the Australian Consumer Law that cannot be excluded or limited. If the Australian Consumer Law applies, our liability for a breach of a consumer guarantee is limited to re-supplying the services or paying the cost of having the services re-supplied.

11. Termination

You may delete your account at any time by contacting support
Upon deletion, all your personal data and garden data will be permanently removed
We may terminate or suspend your access for violations of these terms

12. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.

13. Changes to Terms

We may update these terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated terms.
