Terms of Use

1. Acceptance of Terms

By accessing or using Plant Planner ("the Service"), operated at plantplanner.com.au, you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service.

2. Description of Service

Plant Planner is a web application that helps Australian home gardeners plan, track, and optimise their raised vegetable garden beds. The Service provides:

  • Crop recommendations based on your climate zone, bed dimensions, and family size
  • Planting schedules and harvest calendars
  • AI-powered garden optimisation and suggestions
  • Email reminders for garden tasks
  • A private bed-photo journal and an optional, moderated community gallery

3. Accounts

  • You must provide accurate information when creating an account
  • You are responsible for maintaining the security of your account
  • One account per person. Accounts are not transferable
  • We reserve the right to suspend or terminate accounts that violate these terms

4. Subscriptions & Payments

  • Free tier: One garden bed for accounts created after 21 August 2026; earlier accounts retain their existing two-bed allowance. No payment required.
  • Paid plans: Grower, Family, Homestead, and any limited Lifetime offer shown on the pricing page
  • Payments are processed securely by Stripe
  • Subscriptions renew automatically. You can cancel at any time
  • We do not offer change-of-mind refunds, credits, or prorated refunds for unused time
  • Nothing in this policy limits remedies that cannot be excluded under the Australian Consumer Law
  • We may change pricing with 30 days notice to existing subscribers

5. User Content

You retain ownership of content you upload, including garden photos and notes. You grant us the limited licence needed to store, process and display that content back to you and the people you authorise to access your garden.

If you separately submit a photo to the community gallery, you grant us a non-exclusive licence to make the approved gallery copy publicly available inside Plant Planner until you withdraw it. Gallery permission does not include advertising, email campaigns, paid promotion or social-media marketing; we will ask separately before any such use.

  • You must own the photo or have permission from its owner
  • You must have permission from every identifiable person shown
  • You may withdraw a gallery photo without deleting its private journal copy
  • Use anonymised, aggregated data to improve our recommendations

You must not upload content that is illegal, offensive, or infringes on others' rights.

6. Community gallery

  • Photos saved to your growth journal are private to the garden by default
  • Sharing is decided per photo and requires an active confirmation; the confirmation is not pre-selected
  • A submitted photo remains private until it passes review
  • An approved item may show the photo, caption, crop or growth stage, month, and the display name and broad region you choose
  • We may reject, suspend or remove content under our community photo standards
  • Repeated or serious breaches may pause new public-gallery submissions without affecting your private journal
  • You may report content or withdraw your own gallery photo at any time

After withdrawal, we stop listing the photo and delete our public copy through our deletion process. We cannot retrieve copies already saved or screenshotted by another person.

7. AI-Powered Features

  • AI suggestions are provided as guidance, not professional agricultural advice
  • Crop recommendations are based on general climate zone data and may not account for your specific microclimate
  • Planting dates and yields are estimates. Actual results vary based on soil, weather, and care
  • We are not liable for crop failures resulting from following AI recommendations

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to the Service or other users' accounts
  • Scrape, crawl, or use automated tools to extract data from the Service
  • Upload malicious content or attempt to compromise the Service's security
  • Resell or redistribute the Service without permission

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by Australian law:

  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid us in the 12 months preceding the claim
  • We do not guarantee uninterrupted access to the Service

10. Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies a consumer guarantee, right, or remedy that cannot lawfully be excluded. Where the Australian Consumer Law permits us to limit a remedy for a non-major failure, we may choose to supply the service again or pay the reasonable cost of having it supplied again. This does not limit remedies available for a major failure or any other non-excludable right.

11. Termination

  • You may request account deletion from Privacy & Data settings
  • Deletion enters a short pending period shown in the product before permanent removal
  • We may retain records where the law requires it or where a record has been de-identified
  • We may terminate or suspend your access for violations of these terms

12. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.

13. Changes to Terms

We may update these terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated terms.
